Terms of Use#

These Terms govern your use of the CapaKit website, documentation, downloads, CapaKit runtime and CLI toolkit, Registry metadata, demo Kits, and related materials.
Scope#
CapaKit provides downloadable local software and developer resources for building, packaging, testing, and running AI apps. CapaKit does not currently provide hosted accounts, hosted workspaces, or managed runtime services.
By accessing the website, downloading the CapaKit CLI, or using CapaKit materials, you agree to these Terms. If you do not agree, do not use CapaKit.
Defined Terms#
In these Terms:
- "CapaKit runtime and CLI toolkit" means the CapaKit CLI, CapaKit runtime, and supporting CapaKit toolkit.
- "CapaKit CLI" means the downloadable
capakitcommand-line tool. - "CapaKit runtime" means the local CapaKit process that prepares, runs, and orchestrates an AI app.
- "CapaKit toolkit" means the supporting developer tooling around the CLI and runtime, including manifests, packaging, testing, Registry access, and workload SDKs.
- "AI app" means the user-facing or agent-facing product built, packaged, or run with CapaKit.
- "Kit" means a CapaKit project source or package for an AI app.
- "Workload" means an isolated execution process running inside a Kit.
- "Registry" means the public catalog of reusable AI app Kits and examples.
CapaKit Runtime and CLI Toolkit License#
The CapaKit runtime and CLI toolkit is free to use, but it is proprietary software. It is not open source and not source available.
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, run, and use the CapaKit runtime and CLI toolkit for personal, internal, development, evaluation, and commercial purposes, free of charge.
We retain all rights, title, and interest in CapaKit. No rights are granted except those expressly stated in these Terms.
License Restrictions#
Except as expressly allowed by these Terms, you may not:
- copy the CapaKit runtime and CLI toolkit except as reasonably necessary to download, install, run, back up, or use it as permitted by these Terms;
- modify, adapt, translate, or create derivative works of the CapaKit runtime and CLI toolkit;
- sell, rent, lease, sublicense, redistribute, or otherwise transfer the CapaKit runtime and CLI toolkit to a third party;
- offer the CapaKit runtime and CLI toolkit as a standalone hosted, embedded, managed, or packaged service that competes with CapaKit without our written permission;
- reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the CapaKit runtime and CLI toolkit, except where applicable law prohibits this restriction;
- remove or alter proprietary notices, trademarks, or attribution;
- use CapaKit for unlawful activity or to infringe third-party rights.
Access to a CapaKit binary does not grant access to source code or any right to receive source code.
Your Kits, AI Apps, and Outputs#
As between you and us, you retain the rights you have in your own Kits, AI apps, Workloads, code, content, configuration, data, and outputs.
Using the CapaKit runtime and CLI toolkit does not give us ownership of your Kits, AI apps, Workloads, code, content, configuration, data, or outputs.
No Hosted Service#
CapaKit is not currently a hosted service. You run the CapaKit CLI, Workloads, dependencies, secrets, model providers, MCP servers, and other integrations in environments you control or configure.
Demo Kits and Registry#
Demo Kits and Registry entries are examples and metadata intended to help you evaluate and learn CapaKit. They are not production services, managed infrastructure, or guaranteed secure templates.
Each demo Kit is governed by the license or terms included with that Kit. If no separate license is provided, you may use the Kit only for evaluation and demonstration.
The CapaKit Registry is hosted on GitHub. GitHub's terms, availability, logging, and policies apply separately to your use of GitHub-hosted resources.
Third-Party Components and Services#
The CapaKit runtime and CLI toolkit may include third-party components governed by their own licenses. Those licenses apply only to those components and do not make CapaKit open source.
CapaKit may interact with third-party services such as GitHub, Docker, package registries, model providers, MCP servers, or other developer tools. We do not control and are not responsible for third-party services, content, availability, security, policies, or behavior.
User Responsibility#
You are responsible for your use of CapaKit, including any Kits, AI apps, Workloads, code, dependencies, containers, model providers, MCP servers, secrets, credentials, generated outputs, network exposure, deployment environments, and legal or compliance obligations you configure or run.
CapaKit is not designed or warranted for safety-critical, life-critical, regulated, or high-risk environments.
Support#
CapaKit is provided without guaranteed support, maintenance, updates, bug fixes, response times, or service levels.
We may accept bug reports, feature requests, and feedback through the CapaKit GitHub Issues tracker or other public channels. Submitting an issue does not create any obligation for us to respond, investigate, fix, maintain, or continue any feature.

Do not include secrets, credentials, private code, confidential information, or sensitive data in GitHub Issues or other public support channels.
Feedback#
If you provide ideas, bug reports, feature requests, suggestions, or other feedback, you grant us a perpetual, worldwide, royalty-free license to use, modify, and incorporate that feedback into CapaKit without obligation to you.
No Warranty#
CapaKit, including the CapaKit runtime and CLI toolkit, website, documentation, Registry metadata, and demo Kits, is provided "as is" and "as available."
To the maximum extent permitted by law, we disclaim all warranties, express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, security, accuracy, availability, and error-free operation.
We do not warrant that CapaKit will meet your requirements, operate without interruption, be secure or error-free, preserve data, work with any particular third-party service, or that defects will be corrected.
Limitation of Liability#
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, goodwill, data, use, security, business interruption, production impact, or third-party claims arising from or related to CapaKit.
Our total liability for any claim related to CapaKit will not exceed the greater of the amount you paid us for CapaKit in the twelve months before the claim or USD $100.
Some jurisdictions do not allow certain exclusions or limitations, so some of the above may not apply to you.
Changes#
We may update these Terms from time to time. The effective date above shows when this page was last updated. Your continued use of CapaKit after changes become effective means you accept the updated Terms.
